Update on Camp Lejeune Justice Act Litigation
As of March 27, 2024, there have been 1,662 suits filed under the Camp Lejeune Justice Act, with approximately 176,662 administrative claims filed with the Navy. Despite these numbers, settlements under the Act have been relatively few.
The Torts Branch has identified 51 cases in litigation that qualify for the Elective Option, including various injuries such as bladder cancer, kidney cancer, non-Hodgkin’s lymphoma, kidney disease, Parkinson’s disease, leukemia, and multiple myeloma. Twenty-one offers have been accepted by plaintiffs, with settlements ranging from $100,000 to $450,000, while nine offers were rejected, and fifteen offers expired.
Additionally, the Department of Justice (DOJ) is settling cases separately from the Torts Branch, with 59 claimants having their offers approved. Twenty-four settlement offers have been accepted, totaling $5,950,000 in payments. However, the pace of the process has left victims frustrated, as it does not align with the intent of Congress.
Settlement Details:
- Bladder Cancer: Settlements of $150,000, $150,000, $300,000, $300,000, and $450,000.
- Kidney Disease (End-Stage Renal Disease): Settlements of $250,000, $250,000, $100,000, and $100,000.
- Kidney Cancer: Settlements of $300,000, $300,000, $300,000, $300,000, and $150,000.
- Non-Hodgkin’s Lymphoma: Settlements of $150,000, $150,000, and $300,000.
- Multiple Myeloma: Settlement of $250,000.
- Parkinson’s Disease: Settlements of $400,000 and $100,000.
- Leukemia: Settlement of $300,000.
