As of April 1, 2024, the multidistrict litigation (MDL) for AFFF exposure has seen an influx of 568 new cases in the last month, bringing the total to 7,738 pending personal injury cases. The court is focused on reviewing scientific evidence linking AFFF to specific types of cancer, with Judge Gergel requesting proposals from both sides on the procedure for selecting bellwether trial cases.
Bellwether trials are important test trials that can influence overall settlements or resolutions. However, based on the current court schedule, no AFFF trials are expected to take place in 2024.
