Dismissal of Unsubstantiated Cases in Paraquat MDL

The Paraquat multidistrict litigation (MDL) involves over 5,000 plaintiffs. Recently, another lawsuit related to Paraquat was voluntarily dismissed, seemingly to avoid a deposition. This decision followed a court order for the plaintiff’s deposition, highlighting a trend where ten out of 34 cases selected for closer examination this year have been voluntarily dismissed.

The dismissal raises questions about the viability of the plaintiff’s claim and the potential impact on their ability to secure a favorable settlement. In MDL cases, settlement calculations often involve a points system that considers various factors, such as the severity of the injury, extent of exposure, and strength of evidence. Plaintiffs with weaker claims may receive lower settlements or no compensation at all under such systems.

While the dismissal of weak cases may streamline the litigation process, it also underscores the need for defendants to evaluate the quality of claims in anticipation of potential global settlements. However, it’s essential to ensure that meritorious cases are not overlooked or delayed in the pursuit of resolution.
